NEW MISSISSIPPI OPEN CARRY LAW ! ! !

HOORAY!

The politicians finally did something right!

For my United States Army birthday present today, I just now learned that Mississippi's firearms law has been amended, and the new law, Mississippi HB2, will take effect on Monday 01 July 2013.


Back in December of 2011, when I obtained my Mississippi Firearms Permit, the issuing state trooper informed me that my weapon must ALWAYS be concealed, for even when licensed, Mississippi did not allow firearms to be visible.

Under current Mississippi law, a holstered pistol is considered to be "partially" concealed, and therefore illegal.

If visibly carried in the hand, then the pistol is considered a threat to the public.

But, according to the newly amended law, a Mississippi Firearms Permit is only required when wearing a concealed firearm. 

No permit is necessary when openly wearing a holstered firearm in plain view.

AN ACT TO AMEND SECTIONS 97-37-1, 97-37-15, 97-37-19 AND 45-9-101, MISSISSIPPI CODE OF 1972, TO CLARIFY THE CARRYING OF CONCEALED WEAPONS; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1.  Section 97-37-1, Mississippi Code of 1972, is amended as follows:

(4)  For the purposes of this section, "concealed" means hidden or obscured from common observation and shall not include any weapon listed in subsection (1) of this section, including, but not limited to, a loaded or unloaded pistol carried upon the person in a sheath, belt holster or shoulder holster that is wholly or partially visible, or carried upon the person in a scabbard or case for carrying the weapon that is wholly or partially visible.

Also, without having probable cause to believe a crime has been committed, police in Mississippi may not demand identification from a private citizen merely because the citizen is wearing a holstered firearm.

There is STILL an unresolved problem with residents of the Armed Forces Retirement Home having their unalienable rights infringed, in blatant violation of our divinely inspired Constitution of the United States of America, by being illegally prohibited from possessing and/or carrying a firearm anywhere on the grounds of the Armed Forces Retirement Home.
